Sidewalk Repair Permit in NYC: Who Needs One and How

Contractor repairing a Manhattan sidewalk

In New York City, most sidewalk repairs need a permit from the NYC Department of Transportation (DOT). The permit costs $70 for up to 300 linear feet of sidewalk on one property. Work that covers less than 25 square feet is exempt, unless you are fixing the sidewalk to clear a violation. Sidewalk sheds are a separate matter: they are permitted by the Department of Buildings (DOB), not DOT.

This guide explains which agency handles what, how to apply, what happens after the work, and where sidewalk sheds fit in. It is written for NYC homeowners, building owners, property managers and facility managers.

TL;DR

  • DOT issues sidewalk repair permits. The fee is $70 for every 300 linear feet of sidewalk for any one property.

  • Small jobs are exempt, with one catch. Work on less than 25 square feet needs no permit, unless the purpose is to remove a violation.

  • Contractors apply online, homeowners may apply by mail. Contractors use nycstreets.net. Homeowners doing their own work can mail a signed application with the required documents.

  • Ask for a dismissal inspection. After repairs, contact NYC311 so a DOT inspector can verify the work.

  • Sidewalk sheds are a DOB permit. They follow different triggers, durations and renewal rules.

Which agency issues which permit

New Yorkers often mix up three different things: the sidewalk repair permit, the building permit, and the sidewalk shed permit.

Work

Agency

What it covers

Sidewalk repair or replacement

NYC DOT

Concrete flags, new installation, repairs to clear a violation

Sidewalk shed

NYC DOB

Overhead protection during construction, demolition or façade work

Building work next to the sidewalk

NYC DOB

Façade, structural and alteration work on the building itself

DOT’s own guidance says a permit is needed for new sidewalk installation and repair. The same rules cover other things owners place on or over the sidewalk, such as canopies and sidewalk furniture. Your property’s tax lot is what ties the permit to you, which is why the fee is calculated per property.

Do you need a permit to repair your sidewalk?

Usually yes. Here is how it breaks down.

Permit required:

  • Replacing or repairing sidewalk flags beyond a small patch.

  • Installing a new sidewalk.

  • Any repair made to remove a Notice of Sidewalk Violation, even a small one.

Permit not required:

The violation exception matters most. If DOT has cited you, a small repair still needs the permit, because the permit and the dismissal inspection are how the violation gets closed out.

What about tree-root damage?

If roots from a street tree lifted your sidewalk, the city may be able to help. The NYC Parks Trees & Sidewalks Program repairs root-related sidewalk damage in some cases. Check with the city before hiring anyone, since the program decides who qualifies and the schedule.

How much the permit costs and what it covers

The fee is $70 for every 300 linear feet of sidewalk for one property. NYC311 explains that it covers administrative costs and the dismissal inspection. So you do not pay a second fee for the inspector’s visit.

A corner lot or a long commercial frontage can exceed 300 linear feet, which means more than one unit of the fee. The permit fee is separate from what your contractor charges for demolition, concrete, forms, finishing and cleanup. We do not publish fixed prices for sidewalk jobs, because frontage length, access, condition of the subbase and the scope of any related building work change the figure from site to site.

How to apply for the permit

The route depends on who is doing the work.

If a contractor does the work

Contractors apply through nycstreets.net. Applicants must be registered with DOT and hold a Permittee ID. The registration process includes submitting insurance and supporting documents, and the Permittee ID issued after review goes on every permit application.

This is one of the practical reasons owners hire a general contractor who already holds that registration. The paperwork, insurance certificates and filing are handled in one place. If you manage several properties and compare bids, tools such as construction estimating and bidding software help track the permit fee, insurance requirements and vendor quotes side by side.

If you are a homeowner doing your own repair

DOT accepts applications by mail from private homeowners who repair their own sidewalk. Per DOT, the package includes:

  1. A signed permit application.

  2. A notarized Affidavit of Ownership.

  3. A stamped, self-addressed envelope.

  4. A $70 certified check payable to the city.

The Street Works Manual notes that homeowners taking out their own sidewalk repair permit are the exception to the registration rule. DOT’s own advice, however, is that owners hire a licensed contractor for sidewalk repairs. Concrete work to city specifications is harder than it looks, and a failed inspection means redoing it.

Deadlines when you have a sidewalk violation

If you received a Notice of Sidewalk Violation, you have 75 days to make repairs. That period is the same all year, and getting a permit does not extend it. So the permit has to be in hand early enough to leave time for scheduling the crew, pouring and curing.

A workable sequence looks like this:

  1. Read the notice and note the date it was issued.

  2. Get the frontage measured and a written scope from a contractor in the first couple of weeks.

  3. File the permit right away.

  4. Complete the repair.

  5. Request the dismissal inspection.

We walk through that timeline in more detail in our guide to clearing a DOT sidewalk violation within 75 days.

After the repair: the dismissal inspection

Once the work is finished, contact NYC311 and request a Sidewalk Violation Dismissal Inspection. A DOT inspector then verifies that the work was completed satisfactorily. Keep your permit, photos of the finished work and any contractor invoices together in case you need to answer questions later.

If the sidewalk work is part of a larger project, such as a storefront renovation, façade repair or an addition, the building permit side runs separately. Our overview of NYC building permit requirements explains when DOB filings come into play.

Sidewalk shed requirements in NYC

A sidewalk shed is the covered walkway you see in front of buildings under work. It protects pedestrians from falling debris. The DOB issues the permit, and the triggers are specific:

  • Constructing a building more than 40 feet high.

  • Demolishing a building more than 25 feet high.

  • Any situation where danger requires protecting the public.

A ground-level sidewalk repair on its own does not call for a shed. Sheds come in with façade work, roof work, structural alterations and similar jobs.

Duration, renewal and removal

DOB’s page says initial shed permits are generally valid for one year or until the contractor’s insurance expires, whichever is shorter. Renewal requests go to the LAA/Permit Renewal Unit or the appropriate Borough Commissioner.

Rules have tightened recently. Reporting on DOB’s service notice describes permits for sheds tied to façade or building repairs capped at 90 days, with renewal fees and penalties from the second renewal. Those shorter limits do not apply to sheds on permitted new buildings, enlargements or demolition. Because the details have been changing, confirm the current duration and renewal terms on the DOB sidewalk shed page before you budget a long project.

When the work is done, the shed has to come down properly. Removal requests go through DOB NOW: Build. The Construction Safety Compliance Unit schedules an inspection, and the request is approved once the inspection reaches Pass/Final status. Leaving a shed up past the need costs owners money and annoys tenants and neighbors, so plan the takedown into the schedule.

What about northern New Jersey, Long Island and Westchester?

Everything above is specific to New York City. DOT and DOB permits apply only to NYC sidewalks and buildings. Outside the five boroughs, sidewalk work is typically governed by the local municipality, county or state road authority, and each has its own forms, fees and inspectors. We serve owners across Long Island, Westchester County and northern New Jersey, and in those areas we confirm the local permitting body for the specific address before pricing the job.

Our perspective

Sidewalk permits look simple on paper: a $70 fee and a form. In practice, we see delays come from the details around it. Measurements that do not match the permit, a violation clock that is already running, or a repair that is finished but never inspected.   Our approach at DJ Custom Contracting is to treat the sidewalk as part of the whole property. We are a licensed and insured general contractor, and we handle DOT and DOB violation removal along with the repair work. That means one team can measure, file, build and follow through to the dismissal inspection.   For property managers and facility managers, we pair this with maintenance work. Exterior envelope repair and waterproofing, masonry restoration and routine upkeep reduce the chance that a sidewalk or façade problem turns into a violation or a shed.   Our rule is simple: know which agency you are dealing with, start the clock early and keep records. Do that, and a sidewalk repair is a manageable job.   DJ

FAQ

Do I need a permit to fix my sidewalk in NYC?

Yes, for most repairs. The exception is work on less than 25 square feet, and that exception does not apply when the repair is meant to remove a violation. When in doubt, file the permit, since it also covers the dismissal inspection.

How much does a sidewalk repair permit cost in NYC?

The fee is $70 for every 300 linear feet of sidewalk for any one property. It covers administrative costs and the inspector’s dismissal visit. Your contractor’s price for the actual repair is separate.

Who can apply for the permit?

Registered contractors apply online through nycstreets.net with their Permittee ID. Homeowners repairing their own sidewalk can apply by mail with a notarized Affidavit of Ownership and a $70 certified check. DOT recommends hiring a licensed contractor.

What happens after the repair is finished?

Contact NYC311 to request a Sidewalk Violation Dismissal Inspection. A DOT inspector checks that the work was completed satisfactorily. Keep your permit and invoices on file.

Who issues a sidewalk shed permit?

The NYC Department of Buildings issues it, not DOT. Sheds are required for buildings over 40 feet under construction, demolitions over 25 feet, or when danger requires protecting the public.
